Temporary Protected Status (TPS)

GENERAL INFORMATION ON TPS

Temporary Protected Status (TPS) is a form of lawful non-immigrant status for foreign nationals; in effect, it creates a temporary “safe haven” in the United States for certain foreign nationals currently in the country.

TPS is available to nationals (and habitual residents) of certain countries that have been designated for TPS due to ongoing temporary conditions in those countries. TPS is, by its name and nature, a temporary designation: it is established for a period of six to 18 months, but extensions are possible.

The secretary of the Department of Homeland Security determines which countries shall be granted TPS due to conditions that would make it inhumane for the United States to repatriate aliens to those countries, such as:

• armed conflict (e.g. war, rebellion, genocide)
• an environmental disaster (e.g. an earthquake, tsunami, epidemic

Recipients of TPS are granted several benefits during the TPS period

• protection from removal or deportation
• employment authorization for up to a year
• immunity from status-related detention
• ability to travel abroad with advance permission
• eligibility for Adjustment of Status (and Cancellation of Removal later)
